GENERAL TERMS AND CONDITIONS (WITH LEGAL INFORMATION)

§ 1 Scope and supplier
These General Terms and Conditions apply to all orders placed via the online store of Schreinerei Wilhelm KG, owner: Andreas Wilhelm, Beethovenstr. 10, 86316 Friedberg-West, info@schuhbutler.de, T +49 821 2628415, F +49 821 666991 (hereinafter: Schreinerei Wilhelm).

§ 2 Conclusion of contract

§ 2.1 The product representations in the online store serve for submission of a purchase offer. By clicking the [binding order] button, you submit a binding purchase offer. Our products are sold for private use only.§ 2.2 We may accept your order by sending a separate order confirmation by e-mail. The receipt of the order is confirmed automatically by email immediately after the order has been submitted and does not yet constitute acceptance of the contract.

§ 3 Prices
The prices stated on the product pages include the statutory value-added tax and other price components and do not include shipping costs.

§ 4 Shipping costs
For delivery and assembly within Germany (mainland) we charge a flat rate of €119 incl. VAT for the first-ordered element. Each additional element is charged with additional €62 incl. VAT. To Austria the delivery incl. assembly is €138 incl. VAT and for each additional cabinet €70 incl. VAT.

§ 5 Terms of delivery and reservation of self-delivery

§ 5.1 Delivery is made within Germany (mainland) and Austria with our delivery service.

§ 5.2 Unless otherwise stated in the offer, the delivery time is 84 days.

§ 5.3 If the delivery of goods fails due to your fault despite three delivery attempts, you shall be in default of acceptance. In this case, we are entitled to charge reasonable storage costs for the goods.

§ 5.4 If the ordered product is not available because we are not supplied with this product or components by our suppliers through no fault of our own, we may withdraw from the contract. In this case, we will inform you immediately and, if necessary, suggest the delivery of a comparable product. If no comparable product is available or if you do not wish to receive a comparable product, we will immediately refund any consideration already paid.

§ 6 Terms of payment

§ 6.1 Payment shall be made either in advance or by cash/EC card upon delivery.

§ 6.2 If you are in default of payment, the purchase price shall bear interest at a rate of 5 percentage points above the prime rate during the period of default. We reserve the right to prove and claim higher damages caused by default.

§ 7 Retention of title
The goods remain our property until full payment. Prior to transfer of ownership, no pledging, transfer by way of security, processing or transformation is permitted without our consent.

§ 8 Withdrawal policy
Our products are manufactured individually according to your specifications. Therefore, no right of withdrawal exists for these contracts, Section 312g para. 2 no. 1 BGB (German Civil Code).

§ 9 Transport damage

§ 9.1 If goods are delivered with obvious transport damage, please complain about such defects immediately to the delivery person and contact us as soon as possible (T +49 821 2628415).

§ 9.2 Failure to make a complaint or to contact us has no consequences for your statutory warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

§ 10 Warranty
Statutory warranty rights exist for the articles offered in our store.

§ 11 Concluding provisions
Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid.

The relevant statutory provisions shall apply in place of the invalid provision.

How does the shopping cart system work?

You can place a hold on products without obligation by clicking on the Add to shopping cart button. You can view your shopping cart at any time by clicking on the Shopping cart button and remove products from the shopping cart by clicking on the Delete button. If you want to buy the products in the shopping cart, click on the To checkout button.

Do I need to register?

After selecting the products, you will be asked to enter your details. The mandatory information is marked with an asterisk. Optionally, you can open a customer account and after entering your user name and password place orders without having to re-enter your address details.

When will my order become binding?

You can check your information again on the order page. By clicking on the Buy/order for a fee button you complete the order process. You can cancel the operation at any time by closing the browser window. On the individual pages, you will find further information, e.g. on correction options.

Revocation

Our products are individually manufactured according to your specifications. Once your order confirmation has been approved, the contract cannot be rescinded, Section 312g para. 2 No. 1 German Civil Code (BGB). (See also our General Terms and Conditions Section 8)

Will the contract text be stored?

We store the contract text. The order data and the General Terms and Conditions will be sent to you by email. If you activate the XY option, you can also view your past orders in our customer login area. You can view, print, and save the General Terms and Conditions here.

Note according to the Battery Act

Since our shipments may contain batteries and rechargeable batteries, we are required by the Battery Act (BattG) to inform you of the following: Batteries and rechargeable batteries must not be disposed of as household waste, but you are legally obligated to return used batteries and rechargeable batteries. Waste batteries can contain harmful substances that, if not stored or disposed of properly, can harm the environment or your health. However, batteries also contain important raw materials such as iron, zinc, manganese, or nickel and can be recycled. After use, you can either send the batteries back to us or return them to us in your immediate vicinity (e.g. at retail or municipal collection points or in our shipping warehouse) free of charge. Dispensing at points of sale is limited to end-users for normal quantities as well as those used batteries which the distributor carries or has carried as new batteries in its assortment.

The symbol with the crossed-out garbage can means that you are not allowed to dispose of batteries
and rechargeable batteries in household waste. Under this symbol, you will also find

the following symbols with the meanings listed below:
